State concedes the notebook found at the Richins home during the 1st search warrant was illegally obtained. The defense is hoping to have it tossed as well as other evidence they consider as "fruit of the poisonous tree". The state says it would have been found shortly after the search warrant and wants the judge to consider the notebook as inevitable discovery and allow it in.
